Is your tax return "frozen" if you are in a Chapter 13 bankruptcy? Does the IRS just hold the money? Or, do they send it to you? (we do not have anything signed with our trustee stating it would go to them)
The IRS does not hold your money, if you are due a refund you will get it in the normal time frame. Your creditors can then make a claim against this money. If you have not filed your tax return yet and are expecting a refund you might want to talk to your lawyer to see if he has a suggestion as to how your refund might be protected. Talk to your lawyer not the trustee, not all lawyers will help you on this. You will not be breaking the law, but you might be stretching ethics. It is up to your lawyer how to handle this,.
