I have Kaiser and need to keep my coverage because I may not be approved if I try to reapply somewhere else. But I have a medical bill with them that I plan to include in a chapter 7 bankruptcy. Has anyone gone through this? Will Kaiser drop me if that bill gets discharged? Thanks for the help!

Good Luck…
I filed for chapter 7 bankruptcy in 2005 and we did not include the house. Now my wife & I will be getting a divorce. Is it possible to file a Joint Bankruptcy when it has been only 4 years since I filed myself? We’re in Tennessee if that matters.
Sorry, I couldn’t remember the word "re-affrimed" when I was typing my original question. I did re-affirm the house during the Chapter 7 filing.
Since it has only been 4 years since the last time you filed, your only option for bankruptcy at this point is a Chapter 13 where you will be expected to pay monthly toward your debts.
Did you have the mortgage when you filed 4 years ago? If so, you were required to include that debt in the bankruptcy. If you did not, you committed fraud. Look at your BK paperwork or contact your lawyer from 4 years ago to verify the debt was included. If you did include it, unless you reaffirmed the debt, you do not have to pay the mortgage. You can walk away.
If you did not include the house, if you file now, they will figure out you failed to list all your debts and may examine your old case.
My sister has been on SSI ( social security income ) due to a disability for a few years. She got 3judgmentsered judgments against her from creditors ( about $ 10,000), she has no way to pay now. I advised her to file chapter 7 bankruptcy to wipe out this debt, Is it legal to file for chapter 7 bankruptcy in this case ?
Thanks for help
Your sister can file for bankruptcy but the regulations require spending a year in credit counseling which you pay for, then the actual bankruptcy costs are for the lawyer and around $300 for court costs.
A much easier way in her situation would be to send all her creditors a letter stating she is judgment-proof because she is on SSI and has no assets, and quote the section of the Fair Debt Collection Act in the letter. That will probably end the problem.
Before she gets sued for these debts I suggest sending the letters to each creditor. You can find this form letter on line at several websites.
I filed Chapter 7 and before we had the chance to remove the recorded Judgements, the court discharged the case and closed it. I wonder how to remove the judgements without re-opening the case. We know that the judgements were wiped out in the bankruptcy, but not sure how the recording can be voided and removed?
So if I attempt to purchase real estate in a couple of years, the escrow and title companies wouldn’t bother asking me to deal with those judgements???
You can file a dispute with the bureaus, tell them that debt was discharged in your bankruptcy (you might provided them with a copy of your discharge papers). The bureaus should note the judgment as "Judgment in Bankruptcy". But it will not be removed — it will remain on your credit report for 7 years from date of entry.
I’m stuck in a horrible cycle of paying one loan off and then going back the next day to get the money to pay the next one. I am going to file chapter 7 bankruptcy. It takes about 3-4 months to complete. What should I do with the loans that I owe now? Please help!! Thank you
I plan to include them in my bank, but what do I do with them while I am filing? Any idea’s?
Thanks again
Has anyone been thru this before?
Include them in your chapter 7 and have your lawyer send out the letters to the creditors…
Talk to your bankruptcy lawyer… he will explain the whole process and yes, definitely include those pay day loans into your bankruptcy.
They are "unsecured" loans and can be discharged just like credit card debt.
here is our situation
My wife and I make a little more than enough to qualify for chapter 7 bankruptcy. I had a loss in income, and my wife wants to stay at home with our son. Our son is in daycare for 10 hours per day, and we no longer want to live like this. If my wife quits her job to stay at home with the kids, will the court come back on us?
We are also overwhelmed with debt currently.
Isn’t that what bankrupty is, to have a fresh start?
most likely you’d qualify without her quitting.
Ok so, I have no money, which is why I’m filing for bankruptcy, yet it costs money to file bankruptcy. Make sense? Anyway, I have never been through this before and was wondering if anyone could tell me how much it costs to file for chapter 7 (which I have checked into and am eligible for) bankruptcy? Thank you all in advance for your answers.
The full cost to file for bankruptcy is £485. However the court will waive £150 of the fees if you are earn less than £14,600 p.a. or are on benefits…so this would reduce the fee to £335…
When filing chapter 7 bankruptcy as an individual can I use my son towards my household size if I have joint custody with my ex-husband.
Your household size is not the same thing as the number of dependents or custody arrangement. If your child lives in your household you can claim him. If not, no. If your child only lives in your house at certain times (e.g., summers with you, school years with other parent) then you answer the question according to what your household size is on the day you file the bankruptcy petition.
I am filing chapter 7 bankruptcy, but have a case w/ the EEOC against my former employer for discrimination. If I receive back wages or a cash settlement, will I be able to keep that money?
This answer is very tricky and can be given only by Bankruptcy Attorneys’ only. Check out below site for detailed answer.
