I want to sue a company that closed down because of an unpaid balance. However, I am not sure if they have filed for bankruptcy protection or not.
Assume that they have filed for bankruptcy, can I still sue them in small claims?
Wouldn’t you be ahead of the game to make a claim against them with the bankruptcy court? Unpaid balance makes you a creditor; possibly secured.
