With the changes in the bankruptcy laws, are there limits in place as to filing for Chapter 7 or 13 bankruptcy protection within a certain number of years? Can you file within 7 years of a previous bankruptcy judgement?
The limits pertain to getting a discharge, not to filing.
You cannot obtain a discharge in a Chapter 7 bankruptcy if you received a Chapter 7 discharge within the past 8 years or a discharge in a Chapter 13 case within the past 6 years.
You cannot obtain a discharge in a Chapter 13 bankruptcy if you obtained a discharge in a Chapter 7 bankruptcy within the past 4 years or a Chapter 13 within the past 2 years.
